Terms and Conditions

1. Purpose

These Terms and Conditions govern the rental of mountain safety equipment, including avalanche transceivers (DVA/ARVA), shovels, and probes, offered by Location DVA Annecy (hereinafter "the Rental Provider") to any individual or legal entity (hereinafter "the Renter").

2. Booking

Equipment booking is made through the contact form available on the website. Any booking is considered final after written confirmation (email or SMS) from the Rental Provider.

3. Rates

Rental rates are as follows:

These rates include all taxes and are valid for the current season. The Rental Provider reserves the right to modify rates at any time.

4. Deposit

A €300 cash deposit is required when picking up the equipment. This deposit is fully refunded upon return of the equipment in its original condition, without damage or missing items.

In case of damage, loss, or theft of the equipment, the deposit amount will be retained to cover repair or replacement costs.

5. Equipment Pickup and Return

5.1 Pickup

Equipment is to be picked up at the address provided during booking confirmation, in Annecy. Pickup times are agreed upon between the Rental Provider and the Renter.

The Renter must present a valid ID at pickup.

5.2 Return

Equipment must be returned at the agreed date and time. Any unreported delay may result in additional days being charged at the daily rate.

Equipment must be returned clean and in good working condition. The Renter agrees to inspect the equipment with the Rental Provider upon return.

7.1 Renter's Liability

The Renter is responsible for the rented equipment during the entire rental period. They are liable for any damage, loss, or theft occurring to the equipment during this period.

The Renter is solely responsible for their use of the equipment and any consequences that may arise. The Rental Provider cannot be held liable for any accident, injury, or damage resulting from equipment use.

7.2 Insurance

It is strongly recommended that the Renter obtain insurance covering mountain activities and including civil liability.

7.3 Limitation of Rental Provider's Liability

The Rental Provider commits to providing equipment in good working condition, checked before each rental. However, the Rental Provider cannot be held liable for:

Important Warning: The avalanche transceiver is safety equipment intended for experienced practitioners. The Renter acknowledges:

The Rental Provider may provide a basic demonstration of equipment operation, but this in no way replaces complete mountain safety training.

9. Cancellation

Any cancellation must be reported at least 48 hours before the scheduled pickup date. After this deadline, 50% of the rental amount will remain due.

The Rental Provider reserves the right to cancel a booking in case of force majeure or equipment unavailability, in which case the Renter will be fully refunded if they have already paid a deposit.

Payment is made in cash when picking up the equipment. Credit card or check payments are not currently accepted.

11. Personal Data

Personal data collected during booking is used solely for rental management and is not shared with third parties. In accordance with GDPR, the Renter has the right to access, rectify, and delete their data.

12. Applicable Law and Disputes

These Terms and Conditions are governed by French law. In case of dispute, and after attempting amicable resolution, the competent courts shall be those of the Rental Provider's registered office.

Booking equipment implies unreserved acceptance of these Terms and Conditions by the Renter.
